These Terms and Conditions set out the basis on which Gardeners Haggerston provides gardening and related services to you as a customer in the United Kingdom. By making a booking, confirming an appointment, or allowing our team to commence work at your property, you agree to be bound by these Terms and Conditions.

If you do not agree to any part of these Terms and Conditions, you should not proceed with a booking or use our services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Customer means the person or business requesting or receiving the services from Gardeners Haggerston.

Services means gardening and garden-related services provided by Gardeners Haggerston, which may include but are not limited to lawn care, hedge trimming, planting, weeding, garden tidying, pressure washing of external hard surfaces, and related maintenance activities.

Property means the residential or commercial address or outside space where the services are to be carried out.

Agreement means the contract between Gardeners Haggerston and the customer formed in accordance with these Terms and Conditions.

2. Scope of Services

Gardeners Haggerston will provide the services as agreed at the time of booking or as subsequently confirmed in writing. The description of the work may include a general garden maintenance visit, a one-off tidy-up, regular scheduled maintenance, or other specific tasks as discussed with the customer.

Any description of services, whether given verbally or in writing, is a guide to the work that will be carried out. Gardeners Haggerston reserves the right to adapt the method of working where reasonably necessary in order to complete the work safely, efficiently, and to a reasonable standard, provided that the overall nature of the services is not significantly changed.

Where the work is dependent on access to certain areas, water supply, or electricity, the customer must ensure that these are available and in working order for the duration of the visit, unless otherwise agreed in advance.

3. Booking Process

Bookings for services can be made by contacting Gardeners Haggerston through its usual communication channels. When requesting a booking, you should provide accurate information about your property, the type of garden work required, and any access restrictions.

A booking will be considered provisional until it has been accepted by Gardeners Haggerston. Acceptance may take the form of a verbal confirmation, a written confirmation, or the issuance of a booking reference. Once accepted, a binding agreement will be formed between you and Gardeners Haggerston, subject to these Terms and Conditions.

Gardeners Haggerston may request photographs or a description of the property and garden condition to provide an estimate of time and cost. Any estimate given based on such information is indicative only and may be adjusted upon arrival if the condition of the garden or the scope of work differs materially from that described.

Gardeners Haggerston reserves the right to decline any booking request at its sole discretion, including where the requested services are outside its usual scope of work or service area, or where there is a health and safety concern.

4. Prices, Estimates, and Quotes

Prices for services may be charged on an hourly rate, a fixed price, or a combination of both, depending on the nature of the work. The method of pricing will be communicated to you at or before the time of booking.

Where an estimate or quote is provided prior to the visit, Gardeners Haggerston will use reasonable efforts to adhere to it. However, the final price may vary if the work takes longer than anticipated, if additional tasks are requested, or if the garden condition is significantly different from what was originally described.

Any additional work not agreed at the time of booking may be refused, or if accepted may incur additional charges. You will be notified of any material change in price before such additional work is carried out wherever reasonably possible.

5. Payments and Invoicing

Payment terms will be communicated when you make your booking. Unless otherwise agreed, payment is due on completion of the services on the day of the visit.

Gardeners Haggerston may accept a range of payment methods, such as bank transfer or card payment, subject to availability at the time of service. The accepted payment options will be confirmed during the booking process or at the time of invoicing.

Where work is carried out for a business customer or for larger projects, Gardeners Haggerston may issue an invoice with a specified payment due date. Payment must be made in full by the due date indicated on the invoice.

If payment is not received by the due date, Gardeners Haggerston reserves the right to charge reasonable interest on the overdue amount and to recover any additional costs incurred in pursuing late payment, including debt collection costs, subject to applicable UK law.

6. Cancellations and Rescheduling

You may cancel or reschedule a booking by providing reasonable notice to Gardeners Haggerston. The minimum notice period required will usually be communicated at the time of booking. As a general guideline, at least 24 hours notice for standard visits is requested where possible.

Where adequate notice is given, no cancellation fee will normally be applied. However, Gardeners Haggerston reserves the right to charge a reasonable cancellation fee where:

Cancellation or rescheduling occurs with short notice, meaning the scheduled visit cannot reasonably be reallocated to another customer.

Our team has already travelled to or arrived at your property and is unable to proceed due to cancellation, access issues, or other reasons within your reasonable control.

Gardeners Haggerston may cancel or reschedule a booking in the event of staff illness, severe weather, unsafe working conditions, vehicle breakdown, or other circumstances beyond its reasonable control. In such cases, we will aim to provide as much notice as possible and to agree a new appointment date. Gardeners Haggerston will not be liable for any loss resulting from such cancellations or delays, provided reasonable efforts are made to rearrange the visit.

7. Customer Responsibilities and Access

You are responsible for ensuring that our team can gain safe and reasonable access to your property at the agreed time. This includes ensuring that gates are unlocked or that arrangements are made to provide access on the day of the visit.

You must inform Gardeners Haggerston of any hazards or risks at your property that could affect the safe provision of services, including uneven ground, fragile surfaces, underground utilities, or the presence of aggressive animals. Dogs and other pets should be kept under control and away from the immediate working area during the visit.

If our team is unable to access the property or perform the work safely due to circumstances within your reasonable control, Gardeners Haggerston may treat this as a late cancellation and may charge a call-out or cancellation fee.

8. Standards of Work and Complaints

Gardeners Haggerston aims to provide services with reasonable care and skill and to leave the work area in a tidy condition upon completion. If you have any concerns about the standard of work, you should raise them as soon as possible, preferably while our team is still on site, so that any issues can be addressed promptly.

If a problem becomes apparent after the visit, you should contact Gardeners Haggerston within a reasonable time, providing details and, where possible, photographs. We will review your concerns and, if the issue arises from our failure to provide the services with reasonable care and skill, we will aim to rectify the problem within a reasonable time or offer an appropriate remedy in accordance with your statutory rights.

9. Tools, Equipment, and Materials

Unless otherwise agreed, Gardeners Haggerston will provide its own tools and equipment necessary to carry out the services. All tools and equipment remain the property of Gardeners Haggerston and must not be used by the customer without prior permission.

Where materials such as plants, soil, mulch, or gardening supplies are required, these may be sourced by Gardeners Haggerston and charged to you at cost plus a reasonable handling or sourcing fee, if applicable. You will be informed of any material costs before they are incurred, where reasonably practicable.

Any manufacturer guarantees or warranties applicable to materials or products supplied will be passed on to you where possible. Gardeners Haggerston is not responsible for natural variations in plants, weather-related damage, or the long-term performance of living materials beyond what is reasonable for normal gardening services.

10. Garden Waste and Waste Regulations

Gardeners Haggerston will always aim to manage garden waste in line with applicable UK waste regulations and environmental best practice. The handling of waste for each visit will be agreed with you in advance.

Options may include leaving garden waste neatly bagged or stacked on your property for disposal via your local authority garden waste collection, or removing waste from the property where we have agreed to do so. Where Gardeners Haggerston removes garden waste, an additional charge may apply to cover disposal costs and any relevant waste carrier requirements.

Gardeners Haggerston is not responsible for disposing of hazardous waste or materials that fall outside normal garden waste, such as building rubble, chemical containers, or contaminated soil, unless expressly agreed in writing and subject to additional charges and regulatory requirements.

11. Liability and Limitations

Gardeners Haggerston will carry out the services with reasonable care and skill and in accordance with applicable UK law. However, our liability to you is subject to the following limitations, to the fullest extent permitted by law.

Gardeners Haggerston will not be liable for:

Any loss or damage arising from inaccurate or incomplete information provided by you.

Any pre-existing faults, weaknesses, or defects at the property, including in plants, lawns, trees, structures, paving, or utilities, which may become apparent or be exacerbated during the course of our work.

Damage caused by necessary and reasonable gardening work, such as cutting back overgrown vegetation, where this has been agreed or is inherently required by the requested services.

Any indirect or consequential losses, loss of profit, loss of enjoyment, or loss of opportunity.

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot legally be excluded or limited under UK law.

Subject to the above, our total liability to you in respect of any single incident or series of connected incidents shall not exceed the total price paid or payable by you for the services giving rise to the claim.

12. Insurance

Gardeners Haggerston aims to maintain appropriate insurance cover for its gardening activities, including public liability insurance, in line with industry practice. Details of current insurance cover can be provided upon reasonable request.

13. Health and Safety

Gardeners Haggerston will operate with regard to applicable health and safety requirements when working at your property. Our team may refuse to carry out or may suspend work if conditions are unsafe, including severe weather, unsafe structures, or obstructions that create undue risk.

You agree not to request any work that would require our team to act in an unsafe manner or without appropriate equipment. This includes work at excessive height, near live electrical sources, or involving hazardous substances, unless both parties have expressly agreed suitable safety arrangements.

14. Force Majeure

Gardeners Haggerston will not be liable for any failure or delay in performing its obligations under these Terms and Conditions where such failure or delay results from events or circumstances beyond its reasonable control. These may include severe weather, acts of nature, illness, accidents, transport disruptions, or changes in law or regulation.

15. Personal Data

Gardeners Haggerston will handle any personal data you provide, such as your name, address, and contact details, in a manner consistent with applicable UK data protection laws. Your information will be used for managing bookings, delivering services, handling payments, and communicating with you about your appointments and related matters.

We will not sell your personal data to third parties. Information may be shared with service providers where necessary for the provision of services or for legal or regulatory reasons.

16. Amendments to These Terms

Gardeners Haggerston may update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings made after the updated terms are made available. The terms in force at the time of your booking will usually apply to that booking, unless a change in law or regulation requires earlier application.

17. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.

You and Gardeners Haggerston agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or relating to these Terms and Conditions or the services provided.

18. Entire Agreement

These Terms and Conditions, together with any written confirmation of your booking and any agreed variations, constitute the entire agreement between you and Gardeners Haggerston in relation to the provision of services. You acknowledge that you have not relied on any statement, promise, or representation that is not expressly set out in this agreement.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

By proceeding with a booking or by allowing Gardeners Haggerston to commence work at your property, you confirm that you have read, understood, and agree to these Terms and Conditions.
